Hi Everyone,
Need some inputs urgently. I recently joined a company. They had posted job offering all over the place without much success. Finally they decided to hire me on H1.
Now while initiating the Green Card process, I am being told
"Nothing can be used from our original recruiting as there are strict guidelines on the resources that must be used for the recruiting (i.e. posted on our website for 10 days and screen shots taken every day, etc.). Everything needs to be started from scratch"
Is this correct? What is the correct process in PERM?
Here is what the Attorney's office says:
"The entire labor certification process, from initial preparation to recruitment to approval of the application, takes about 6 months. However, we will work very closely with your office to complete the necessary steps in the least amount of time feasible. Once we receive the inputs from your office, we will work with you to prepare the job description and minimum requirements. Once that is finalized we will identify the recruitment options and begin recruitment. We must file the application within 180 days from the first date the recruitment begins. Our target date to file is 90 days after the first date the requirement begins"
Please advise. Is all the above correct or is there something being quoted incorrectly.

Why? Well that is what I heard. If you are married to US citizen applying for GC, your sponse has to be in the interview.
I don't know why you ask me why.
99.999999 % of the people on this forum are Employment Based applicants who do not need interview. That was the reason.
You should have started by saying that you married a US citizen.

Below is what I think to your three case scenario:
Case 1: According to the USCIS's rule of last action, whichever petition or application came out last is your new non-immigrant status. So if your H1b transfer gets approved first and then your H-1B -> F1 gets approved, you are in F-1, or vice versa. But then if your first H1B has already expired before you turn in your F-1 application, it gets a little complicated. In that case, the F-1 application cannot be approved before the H1B transfer is approved.
case 2: If your first H1B is still valid, then it is ok if your H1B transfer is denied. If your first H1B is expired already before your submit your F-1 application, and your H1B transfer gets denied, you could be out of status.
case 3: If your H1B transfer is approved, and F-1 application is denied, you are still in H1B.

Yepp, many companies have regulation not to release copy of I-140 to applicant unless applicant is leaving them.

my wife has got H1 this year and
she wants to transfer to H4 as she got Ead and she
wants to use EAD .and still we didnt get AP.she wants
to leave to india in jan she dont have stamp in her
passport
if we apply now for the conversion of H1 to H4 can
she leave to india now and can i send that approval
letter to india then she goes to stamping in india.
is it possible. please suggest me

You got that right! Once a citizen you can choose to leave and enter whenever and stay outside the country for as long as you want.

Reminded me of an incident when I was a teenager, a budding cricketer and was a huge fan of Nike sports shoes. I would see these uncles with big paunches wearing Nike and would think that the world is unfair that people like me don't get to wear Nike while random uncles do. Completely random thought!!!!
The point being - the situation we are in, we hope that our plight should be a discussion point in every conversation that India and US ensue in. It crossed my mind a couple of times that we should have pushed for it. State of mind I guess.
Do you think anyone will even mention (hopefully get solutions) the eb backlogs to the President when he is touring India? Do you think anything good might come out of it for us?

No, it does not include the spouse's application. The fee schedule will give you a good idea of what the fees are for each category.

I donot think that these people are directly responsible for creating the issue in the first place....It is a reactive response to the anti-immigrant postures of many candidates...Also people like are us are not eligible to donate to immigrantList...Only citizens or premanant residents can contribute to immigrantList.....

I, a July 2 filer, got receipts last week. EADs came on the weekend. No APs yet. Seems like USCIS is still very much backlogged. Taking infopass etc is unlikely to help much. Best is jus wait for another 2-3 weeks. Best of luck...

All options are possible, depends on your personal preference. There is NO good answer.
If your spouse is in H1B and have a stable income, I would suggest the H4 path.

i am currently on my 8th year h1..and on the bench..hoping some projects will come thru in a week or so.
Currently i have been on LOP for almost 5 weeks now..
what do you think would be a good option for me:
a.) Start the process for H4..and find a new job..and transfer H1 and stay till H1 is valid till may 2010..
b.) Be on bench for few more weeks.. and hope someting will work out...(firm has said they wont cancel my h1/140).. they are just being helpful..but?
c.) R2I ASAP...and try for a consular processing....?
d.) go to H4...and R2I in May...then if the Eb2(Dec 2005) dates are current..try for a CP..its a long shot...
i am confused..any suggestions??

requirements on labor was Bachelors Degree with 5 years of experience.
Single source Bachelors degree was the reason for denial.
