Just be candid and talk to your employer. Sometimes they don't even know this as diff ppl in HR handle and interpret cases differently. I would talk to my employer.

There is no 6-year H1B visa. There is only 3-year H1B visa that can be renewed again for a total of 6-years stay on US soil. If you have spent 5 years on US soil and your tourist visa visits add ip to say 5 months, you still have 7 months on your H1B term. Even if you get a new visa it will be only for 7-months validity. Sometimes, USCIS makes a mistake and issues new 3-year visa but that is a gamble. Why not just stay off-US soild for a few months?
I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

The sad part about the Brokow's report is that he focused on H1B issue and not the real problem which is the green card issue.
Yes, people come on H1B - however, for those immigrants to put down the roots, it has to happen through green cards and not H1B extensions (neither one of which was mentioned in the report). I am not sure if this is a two part series, but it should be.
IV members should write to MSNBC Nightly News to do a more in depth story on immigration problems of the high skilled immigrants.

I have similar issue and spoke to my Immig Attorney, who advised me as follows-
(1) In order to maintain your resident alien status, you should be in USA more than 181 days, in other words it is adviseable to stay less than 180 days outside USA.
(2) It is adviseable that you return to USA, ASAP, once you get CRIS email that GC approval has been provided.
(3) I believe you are going to use AP. You would prepare your I-94 card at the POA and the POA officer would ask you where you are employed before putting stamp on I-94. Be prepared to answer that question. Most likely 99%, the POE IO will not ask any proof. However, it is adviseable to have a current job (sort of Employment Verification Letter) and leave letter approval.

I have two question regarding my h4 visa appointment. My husband has Pay stubs (June to Aug)from Company A.And his company B pay stub is from Sep 10th,2007 to till date. When he was switching from Company A to company B, he got 15 days gap. He didn't has pay stub for those number days.
Is Chennai consulate particular about those dates and ask for pay stub in between those dates. Please advice me.
2) My husband lawyer forget to apply my H4 extension. Unknowingly I over stayed in US for one and half month. We talked with lawyer. she told that she applied for H4 extension before, but US CIS over looked that file. So she filled again. That H4 approval is still pending. In the safe side I left US. I am in a very bad condition n would appreciate anyone who can advice me on same. I had been out of status for about 1 yr n 2 months following my denial of I 140 n expiration of H1b, n currently residing in US. Now i have a new approval for H1b from USCIS, a month back. I was instructed by my employer to go back to my native country n get approval from from the consulate n re enter US. My lawyer instructed that i will be barred at the consulate or at the airport due to the history of over stay in US upon re-entering . Is there any one who have heard experinces of this kind ever? plz share your knowledge... thanks
Lawyer is right. If you leave the country, you will be barred for 10 years from re-entry if you accumulated more than 1 year of "unlawful presence" ("out of status" is different and it is not a such a big deal to lose status as long as you do not accumulate unlawful presence). If you stay, you may be able to eventually get green card.
Can you provide more details regarding your timeline? Was I-485 filed? If you had pending I-485, "unlawful presence" counts from the date I-485 has been denied, not from the date H1 has expired.

I have my contract which mentions start date of 25th october 2010 but my H1B petition is still pending and that is the reason once my petition is approved and if I go for visa interview after 25th october would that affect my ability to get visa. My employer is ok with me starting 1-2 weeks late. My petition is H1B cap exempt.
